Terms of Use

By using the Trivia Engine application (“Service”), you agree to be bound by the following terms and conditions (“Terms of Service”).

EnableUC Inc. the creators and operators of the Service reserve the right to update and change the Terms of Service without notice. Any new features that augment or enhances the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time here.

Violation of any of the terms below may result in the immediate discontinuation of your access to the Service. You agree to use the Service at your own risk.

Terms

1. You must be of an age of majority in your state or province of residence.

2. You must provide your full name, a valid email address or phone number and any other information requested in order to complete the sign-up process.

3. You are responsible for maintaining the security of your account and password. EnableUC Inc. cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

4. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Billing

1. Anyone can install the Trivia Engine application from the Teams Store for free and access available content.

2. In order to create and share your own content, you must obtain a Trivia Engine licence as described at https://www.triviaengine.com/pricing.html.

3. The Service is billed in advance on a monthly or annual basis and is non-refundable. There will be no refunds or credits for partial months/years of service, downgrades or unused months with an open account. In order to treat everyone equally, no exceptions will be made.

4. All advertised fees are exclusive of any taxes, levies or duties imposed by taxing authorities. If you are from Canada, HST charges will be charged to your bill.

5. If a Trivia Engine plan is upgraded or downgraded, the new rate will be applied on the next billing cycle (next month or year depending on the subscription) and will be automatically taken on the basis of the payment details provided.

6. Downgrading the Service will result in the loss of content, features or the capacity of an Account. EnableUC Inc. does not accept any liability for such loss.

Cancellation

1. You can cancel your subscription at any time by contacting support@triviaengine.com via email.

2. If you cancel your subscription before the end of your billing period (monthly or annual), your cancellation and downgrade will take effect immediately and you will be not be charged again.

3. You can delete your account by contacting the Trivia Engine team via e-mail: support@triviaengine.com. Your Account will then be removed by our team in a timely manner and will verify when this process has been completed through an email confirmation.

4. All of your content will be immediately deleted from the Service upon deletion. This information can not be recovered once your Account has been removed.

5. EnableUC Inc. in its sole discretion has the right to suspend or terminate your Account and to refuse any and all current or future use of the Service or any other EnableUC Inc. service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account.

Modifications

1. EnableUC Inc. reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof), with or without notice.

2. Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Trivia Engine Site (TriviaEngine.com) or the Service itself.

3. EnableUC Inc. shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Data policy

1. EnableUC Inc. retains data related to your team as stated in the Privacy Policy.

2. You can always request to permanently delete your personal information, as described in the Privacy Policy.

3. User data is stored in Azure Canada Central datacenters. All data is encrypted using industry-standard methods when stored on disk or transmitted over the network. Only authorised Trivia Engine staff may have access to user data. More information in the Privacy Policy.

General Data Protection Regulation (GDPR)

1. If you are based within the European Union, the GDPR will be applicable to you. Under this regulation EnableUC Inc. act as both a data controller (who decides the purpose and manner that personal data is used) and a data processor (who processes data on behalf of the controller, which includes obtaining, recording, adapting, or holding personal data).

2. The lawful basis for collecting your data is:

(a) You provide your consent at the point of registration for us to do so and by accepting our terms and conditions.

(b) Processing your data in the way explained above is necessary for us to provide the Service to users.

(c) Some of that data is processed for the purposes of our legitimate interests.

3. EnableUC Inc. acts as a data controller for team owners who install, license or create content for Trivia Engine. If you are a team owner operating within the EU you must comply with the GDPR and this forms part of our Terms of Service.

4. EnableUC Inc. acts as a data processor for the team members that join existing accounts. EnableUC Inc. requires consent from both team owners and team members to process their data. Furthermore, all users of the Trivia Engine Service have individual rights to their data including to be informed, to access their data at any time, to rectify their data, to erase their data and to restrict processing. 5. If you are based within Canada then PIPEDA regulations will be applicable to you.

General Conditions

1. Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis.

2. You understand that EnableUC Inc. uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. This is subject to the GDPR within EU countries.

3. You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, EnableUC Inc. or any other EnableUC Inc. service.

4. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service or access to the Service without the express written permission by EnableUC Inc.

5. We may, but have no obligation to, remove content and Accounts that are determined as unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

6. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any EnableUC Inc. customer, employee, member or officer will result in immediate Service termination.

7. You understand that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

8. EnableUC Inc. does not warrant that:

a. the Service will meet your specific requirements

b. the Service will be uninterrupted, timely, 100% secure or error-free;

c. the results that may be obtained from the use of the Service will be accurate or reliable;

d. the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations; and

e. any errors in the Service will be corrected.

9. You expressly understand and agree that EnableUC Inc. shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if EnableUC Inc. has been advised of the possibility of such damages) resulting from:

a. the use or the inability to use the Service;

b. the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received, or transactions entered into through or from the Service;

c. data breaches if beyond our control and we have informed you no later than 72 hours since the breach;

d. statements or conduct of any third party on the Service;

e. or any other matter relating to the service.

10. The failure of EnableUC Inc. to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and EnableUC Inc. and govern your use of the Service, superseding any prior agreements between you and EnableUC Inc. (including, but not limited to, any prior versions of the Terms of Service).

11. If one of the provisions of the present Terms and Conditions is declared invalid or non-invocable for any reason, the other provisions will remain applicable without any change.

12. These Terms and Conditions are subject to the Ontario, Canada law and jurisdiction. In case of dispute, the parties will seek an amicable solution before any judicial action. In case of failure of these attempts, any contestation of the validity, interpretation and/ or execution of the present Terms and Conditions shall be made, even in case of plurality of the defendants or in case of indemnifying third parties, to the Ontario jurisdictions.
